My business partner and I are having some difficulties, but there has not been any actual court proceedings started. Should I consider mediation at this time?

Yes. At any given time mediation could be the method that would assist partners in resolving disputes and even remain in partnership. Unless there is immediate and concrete disadvantage for not starting court proceeding to protect one’s rights it could be beneficial to both or more partners to consider mediation to resolve their differences and difficulties.
